Marriott Bonvoy™ Events Company Account Program Terms & Conditions
Effective in February 2019, the loyalty program for Marriott International, Inc. (“Marriott”) is Marriott Bonvoy™ (hereinafter, the “Loyalty Program”). Prior to this, the Loyalty Program operated as a unified program under three names: Marriott Rewards® Program, The Ritz-Carlton Rewards Program, and the Starwood Preferred Guest® Program (the “SPG Program”) (each a “Legacy Program”). These Legacy Programs were operated by Marriott International, Inc. and its subsidiaries, including Marriott Rewards, LLC and Preferred Guest, Inc. (collectively, the “Company”).
Marriott may invite certain companies that meet the eligibility requirements set forth below (“Eligible Company” or “Eligible Companies”) to participate in the Marriott Bonvoy Events Company Account Program (the “Program”), subject to the following terms and conditions (the “Terms and Conditions”).
Any capitalized terms not defined herein will have the meaning ascribed to them in the Loyalty Program terms and conditions, available at https://www.marriott.com/loyalty/terms/default.mi (the “Loyalty Program Rules”) and incorporated herein by reference. All Loyalty Program Rules apply, except as otherwise stated herein. To the extent there is a direct conflict between the Loyalty Program Rules and these Terms and Conditions, these Terms and Conditions prevail with respect to Eligible Companies only.
By joining the Program, or by using the Eligible Company’s Program Account, as defined below, to receive and redeem benefits of the Program, you agree that you have read and accept these Terms and Conditions, the Loyalty Program Rules, and that you have read and accept the Website Terms of Use at www.marriott.com/about/terms-of-use.mi, which are incorporated by reference herein.
These Terms and Conditions supersede all previous terms and conditions applicable to the Program. Except as otherwise expressly prohibited or limited by applicable laws, Marriott reserves the right to amend, modify or supplement these Terms and Conditions (and the structure for earning Awards and Elite Status) at any time, with or without notice. Such changes may affect the value of Points or Miles, or the ability to obtain certain Awards (collectively “Program Rule Changes”). It is the responsibility of the Eligible Company to remain knowledgeable of the Terms and Conditions and any Program Rule Changes. Your continued participation in the Program will constitute your acceptance of any such Program Rule Changes.
1. Program eligibility
- Participation in the Program is by invitation only. Eligible Companies must receive and accept an invitation in order to participate and must abide by all Program requirements. Notwithstanding any language to the contrary in the Loyalty Program Rules, Eligible Companies may earn Points in accordance with these Program Terms and Conditions.
- Eligible Companies must be legal corporate entities registered with the government of the Eligible Company's country, and with a valid tax ID number, business number, or other equivalent documentation.
- Each Eligible Company must have policies in place that prohibit employees who plan meetings for the Eligible Company from earning Loyalty Program benefits under the Loyalty Program, or any similar successor program for meetings and events booked for the Eligible Company. “Participating Properties” are hotels, resorts, and other transient stay properties under the brands that are owned, managed, franchised, licensed by, or have other agreement with Marriott International and that participate in the Loyalty Program. The Eligible Company does not have to prohibit all employees from receiving Loyalty Program benefits for business travel in order to be eligible for the Program.
- Once Marriott confirms a company’s eligibility for membership in the Program, the applicant will be enrolled in the Program as an Eligible Company. Marriott reserves the right, in its sole discretion and without prior written notice, to deny membership in the Program to any company.
- Government employees, government officials, employees of state-owned entity (SOE) and individuals acting on behalf of government agencies, departments and SOEs booking an event on behalf of a government entity or a SOE, as well as third-party commercial intermediaries booking an event on behalf of a non-U.S. governmental entity or SOE are not considered Eligible Loyalty Program Members, and are not eligible to participate in the Program or Marriott Bonvoy Events. In addition, for Participating Properties in Asia, Australia, and the Pacific Islands, intermediaries booking an event on behalf of any government entity or SOE (U.S. or non-U.S.) are not considered Eligible Loyalty Program Members and are not eligible to participate in the Program or Marriott Bonvoy Events.
- The “Program Account” is the Loyalty Program Membership Account assigned to the Eligible Company in connection with the Program. “Eligibility Period” is any full calendar year (January 1 through December 31) after the Eligible Company has been invited by Marriott to participate in the Program. If, by the last day of the applicable Eligibility Period, the Eligible Company has failed to meet the Annual Spend Threshold and the Redemption Requirement (both as defined below), the Company Account will be closed. Upon closure, the Eligible Company will forfeit all accumulated Points and will no longer be eligible to receive any Program Awards beginning in the year following the Eligibility Period.
- Notwithstanding anything to the contrary in these Terms and Conditions, an Eligible Company's eligibility to participate in the Program is at the sole discretion of Marriott. If, on the last day of the Eligibility Period, the Eligible Company has not achieved a minimum of U.S. $500,000 in Qualifying Event Charges at Participating Properties (the “Annual Spend Threshold”), and has not met any additional thresholds required for specific benefits as set forth in these Terms and Conditions, the Eligible Company will not earn the benefits set forth in these Terms and Conditions (the “Program Awards”), and Marriott may remove the Eligible Company from the Program and terminate the Eligible Company’s Program Account. Only Qualifying Events at Participating Properties will count towards achieving the Annual Spend Threshold.
- Effective June 1, 2025, an additional eligibility requirement applies to all active Eligible Company Accounts. In addition to meeting the Annual Spend Threshold, the Eligible Company must redeem a minimum of 30% of their Program Account Point balance (as of January 31 of the current calendar year) by no later than December 31 of the current calendar year (the “Redemption Requirement”) to remain eligible for continued participation in the Program. For the 2025 calendar year only, the Program Account balance will be noted as of May 15, 2025, and the minimum redemption requirement will be 15% of that balance, to be redeemed through December 31, 2025.
2. Account guardian
The Eligible Company is solely responsible for designating and maintaining one (1) Program Account contact (the “Account Guardian”) who must be an individual employee of the Eligible Company with a valid email address registered with Marriott. If the Eligible Company does not appoint an Account Guardian, or the Account Guardian does not provide a valid email address, the Eligible Company will not be able to participate in the Program. The Account Guardian is responsible for activating, setting up and managing the Program Account, and has sole discretion over (1) redeeming any Points in the Eligible Company’s Program Account for any Awards (as described in Section 5), or (2) transferring any Points to any employee of the Eligible Company (each, an “Eligible Employee”) for use in their Loyalty Program Account. The Account Guardian will also be responsible for notifying the Eligible Company of any Program Awards received under the Program and shall comply with all applicable gift and incentive policies.
If the Account Guardian leaves the employment of the Eligible Company or ceases to serve as the Account Guardian for any reason, the Eligible Company must notify Marriott as soon as possible and provide a valid email address for a new Account Guardian. If a PIN is used to secure and access the Program Account and there is a change in the Eligible Company’s Account Guardian, the PIN must also be updated.
3. Program requirements
- Marriott may amend, modify or supplement these Terms and Conditions, as well as any related processes, regulations, travel or other Awards, and special offers, at any time, with or without notice. The Eligible Company’s continued participation in the Program will constitute its acceptance of any such amendment, modification, or supplementation. These changes may include, without limitation, modifications to strategic marketing partner affiliations, rules for earning or using Program Awards, rules for the use of Program Awards, continued availability of Program Awards, Program Award inventory, Program Award types, and the features of special offers. Marriott reserves the right to terminate the entire Program with six (6) months' notice to all then-active Eligible Companies, or immediately upon notice in the event of a termination relating to the substitution of a replacement program. Accordingly, the right of an Eligible Company to receive Program Awards may be terminated six months after Marriott gives notice that it is terminating the Program. An Eligible Company will be considered "active" so long as they have not been removed by Marriott from the Program for any reason. The Eligible Company is responsible for remaining knowledgeable of the Program Terms and Conditions, and any changes, modifications, or additions to the Program.
- Membership in the Program is free and is available to Eligible Companies based in jurisdictions that legally permit participation in loyalty programs.
- The Program Account must be in the name of the Eligible Company, and not in the name of an individual employee of the Eligible Company. The Eligible Company must maintain only one Program Account number.
- Fraud or abuse concerning membership privileges or Program Awards is subject to appropriate administrative and/or legal action by Marriott, including, without limitation, the forfeiture of Program Awards, the termination of Program membership and privileges for the Eligible Company, and any legal or equitable remedies. If, at any time, a computer virus, bug, or other technical problem, including, without limitation, any electronic, hardware or software program, network, internet, or computer malfunction, failure or difficulty of any kind, or any condition caused by events beyond the reasonable control of Marriott, regardless of the cause, affects, compromises, or corrupts the administration or security of the Program, Marriott reserves the right, in its sole discretion, to void any Program Awards that are not obtained through authorized legitimate means and to adjust any unauthorized changes to an Eligible Company's Program Account. In addition, Marriott reserves the right, in its sole discretion, to immediately terminate an Eligible Company's Program Account if the Eligible Company acts in a manner inconsistent with local, state, or federal laws or ordinance; engages in fraudulent, abusive, or improper conduct; misuses Program benefits; is found to be ineligible to participate in the Program; or fails to pay any valid bill or account when due to Marriott or its Participating Properties. Nothing contained in these Terms and Conditions shall limit Marriott in the exercise of any legal or equitable rights or remedies.
- Earning of Program Awards is subject to all applicable laws and regulations and these Terms and Conditions.
- In the event an Eligible Company is no longer active for any reason, including, without limitation, removal from the Program due to failure to maintain the Annual Spend Threshold and Redemption Requirement, its Program Account may be closed at any time. Upon closure, all Program Awards, including any accumulated Points, will be immediately forfeited.
- An Eligible Company cannot have more than one Program Account or Membership Account number. Each Program membership is for the specific Eligible Company and can only be administered by the designated Account Guardian. Marriott shall not be held liable or responsible for any internal Eligible Company policies regarding the Program or Eligible Company Program Awards.
- An Eligible Company is not eligible to earn or receive benefits associated with Loyalty Program Elite Status as described in the Loyalty Program Rules.
- By participating in the Program, the Eligible Company and Account Guardian(s) of the Eligible Company hereby: (a) authorize Marriott and its licensees, agents, employees and others working on its behalf (collectively, the "Marriott Group") to collect, process, and use all the data provided by the Eligible Company, Account Guardian, or any employees of the Eligible Company (including personally identifiable information) for any lawful, business-related purpose that the Marriott Group deems appropriate, and (b) authorize the Marriott Group to store this data at such location(s) and with such party(ies) as the Marriott Group deems appropriate, whether within the Eligible Company’s country of registration, any applicable individual’s country of residence or elsewhere, and for the Marriott Group directly, or through its third party vendor(s), to transmit whether by mail, facsimile or electronically, or by other reliable means, all or part of such data to any location(s) throughout the world that the Marriott Group deems necessary, whether within the applicable individual’s country of residence or elsewhere.
To the extent that the Eligible Company, Account Guardian, or any Eligible Employee provides personal data to the Marriott Group in connection with the Program, the party supplying the personal data confirms that it has consent or another legal basis to provide the personal data to the Marriott Group and for the Marriott Group to process the personal data consistent with these Terms and Conditions and in accordance with the Marriott Group Global Privacy Statement (available at http://www.marriott.com/about/privacy.mi). For clarity, nothing in these Terms and Conditions limits the Marriott Group’s ability to use an individual’s personal data to the extent directed by, consented to or requested by such individual.
- By accepting any Program Awards, an Eligible Employee acknowledges that they are responsible for determining whether they are eligible to receive such Program Awards under applicable laws, gift policies and incentive policies and the Loyalty Program terms and conditions. Any Eligible Employee who receives any such Program Awards must immediately notify the Eligible Company’s Account Guardian (defined in Section 2) if they are not eligible to receive the Program Awards. Marriott bears no responsibility for the issuing of any Program Awards to Eligible Employees.
4. Earning points
- Earning Points for Qualifying Events. If an Eligible Company enters into an agreement to hold a Qualifying Event (as defined in Section 4.a.i.) at a property that participates in Marriott Bonvoy Events, the Eligible Company will earn (i) two base Points for every $1 USD or the currency equivalent that is incurred and paid for Qualifying Event Charges (as defined in Section 4.a.ii.), up to a maximum of 60,000 Points per Qualifying Event. For the avoidance of doubt, an Eligible Company may not earn Loyalty Program Elite Status benefits and will not be eligible to earn additional Points, including, without limitation, any “bonus” Points due to Elite Status. If Marriott determines that a Program Account has been granted Elite Status, Marriott may, in its sole discretion and with or without notice to the Eligible Company, revert the Program Account to “member” status.
- A “Qualifying Event” is an event or meeting that is booked by an Eligible Company that provides its Program Account number in a fully executed Qualifying Event Agreement and is held at a property that participates in Marriott Bonvoy Events. A Qualifying Event does not include: (a) any guest rooms booked in any manner other than under a Qualifying Event Agreement (e.g., individual transient stays are not included), (b) any booking of guest rooms on behalf of Eligible Company where the Eligible Company has elected (whether through an agreement with a property that participates in Marriott Bonvoy Events or otherwise) to have Points awarded to another individual or entity in lieu of being awarded to the Eligible Company, or (c) any booking of guest rooms that are complimentary or barter rooms or meetings, if applicable.
- “Qualifying Event Charges” are any amounts incurred and paid for a Qualifying Event under the applicable Qualifying Event Agreement, including, without limitation, all group guest room revenue (Ten (10) or more guest rooms must actualize on at least one (1) night to qualify as a group), meeting room rental revenue, catering food and beverage revenue that is included in the Qualifying Event Agreement, audiovisual rental revenue, and decorations or props ordered by the Participating Property. Qualifying Event Charges exclude charges for guest room incidentals, food and beverage that is not included in the Qualifying Event Agreement (e.g. charges at a restaurant within the property that participates in Marriott Bonvoy Events), taxes, gratuities, resort fees and related charges.
- Additional Conditions with respect to Earning Points for Qualifying Events.
- For any Qualifying Event that is booked by an Eligible Employee, such Eligible Employee is responsible for notifying the Eligible Company of any Points received in connection with such Qualifying Event and for complying with any applicable laws, gift policies and incentive policies.
- For any Qualifying Event that is booked by or on behalf of the Eligible Company, the Eligible Company must ensure that its Program Account number is referenced in the applicable Qualifying Event Agreement to earn Points for such Qualifying Event. If the Qualifying Event Agreement does not reference the Eligible Company’s Program Account number, the Eligible Company will not earn Points for such Qualifying Event. Marriott will not be responsible for providing any Points to the Eligible Company for any Qualifying Event unless the applicable Qualifying Event Agreement references the Eligible Company’s Program Account number. The Account Guardian is not required to sign any Qualifying Event Agreement in order for the Program Account to earn Points.
- Eligible Companies may not earn Miles in connection with the Program.
- Eligible Companies are not eligible to receive Points for Events that took place prior to the Eligible Company joining the Program.
- Points may not be split between Accounts for any Qualifying Event.
- The amount of Points earned at Participating Properties where a non-U.S. dollar currency is used will be calculated based on Qualifying Charges converted to U.S. dollars at the exchange rate selected by Marriott. This may be the foreign exchange rate used by a property that participates in Marriott Bonvoy Events at check-in, at check-out or another rate selected by Marriott and may not be the same rate used for currency conversions on the Member's folio.
5. Redeeming points
- An Eligible Company may redeem the Points in its Program Account to obtain designated Awards and benefits ("Redemption Awards”) including gift cards and donations to charities, in accordance with the Loyalty Program terms and conditions.
- Redemption Awards may not be exchanged or redeemed by an Eligible Company or Eligible Employee for cash, prizes or credit.
- Redemption Awards are non-transferable by an Eligible Company, except to Eligible Employees.
- Redemption Awards believed to have been bartered, sold, exchanged, or issued fraudulently, or issued to a person or entity other than the Eligible Company or an Eligible Employee will be voided and will not be honored.
- Redemption Awards may not be converted back into Points after being redeemed.
- Types of Redemption Awards:
- Award Redemption Stays. An Eligible Company may redeem Points for an Award Redemption Stay in a standard guest room or Premium Room (with existing bedding) at Participating Properties. This includes, without limitation, Standard Redemption Award, PointSavers™ Award, Free Night Award, Stay for 5, pay for 4 Offer, Premium Room Redemption Awards, and Cash + Points Award. - Redeeming Award Redemption Stays at Participating Properties is subject to availability at the time of reservation and advanced reservations are required.
- The Account Guardian must make the reservation online, following the process outlined in the then-current version of the Company Account Program Guide. The Eligible Company Program Account name and number must remain on the reservation and the actual guest’s name entered separately on the reservation.
- The standard guarantee and cancellation policies of a Participating Property, including without limitation all minimum length of stay requirements, credit card guarantee requirements and charges for late cancellation, no-shows, and early check-out, will apply to Award Redemption Stay reservations.
- Charges for hotel services and other incidentals are not included when Points are redeemed for rooms at Participating Properties and will be the responsibility of the Eligible Company or Eligible Employee utilizing the Award Redemption Stay.
- Award Redemption Stays may only be used for a maximum of nine (9) guest rooms on the same date at the same Participating Property.
- Eligible Employee will not earn or receive Loyalty Program benefits (including, without limitation, Points towards Elite Status) in connection with the Award Redemption Stay.
- If an Eligible Company or an Eligible Employee fails to cancel a guaranteed Award Redemption Stay reservation within the permitted cancellation time, the Participating Property will charge the applicable cancellation fee to the credit card provided by the Eligible Company or Eligible Employee thereof at the time the reservation was made and the Points that had been redeemed will be re-deposited into the Eligible Company’s Program Account or the Eligible Employee’s Account, as applicable.
- Meeting Credits. An Eligible Company may redeem Points for meeting credit (“Meeting Credits” or a “Meeting Credit”) that can be applied toward non-refundable meeting or event charges at participating hotels.
- Redeeming for Meeting Credits is subject to hotel approval and may not be available at all hotels.
- Meeting Credits are non-refundable and Points redeemed for Meeting Credits cannot be returned and Meeting Credits cannot be cancelled or refunded.
- Merchandise Awards. An Eligible Company may redeem Points for merchandise (a “Merchandise Award”) from companies that are affiliated with the Loyalty Program, including without limitation the companies listed on the Loyalty Program website at https://www.marriott.com/loyalty/redeem.mi. Points redeemed in connection with Merchandise Awards are subject to these Terms and Conditions and the Loyalty Program terms and conditions, along with any applicable terms and conditions of the applicable retail partner.
- Professional Memberships. An Eligible Company may redeem Points to receive a credit toward membership, event registration, or education tools with designated professional organizations. Account Guardians should review their guide for available options.
- Sustainability Initiatives. An Eligible Company may redeem Points to support environmental goals and sustainability (“Sustainability Initiatives”) with designated partners. Account Guardians should review their guide for available options.
- An Eligible Company may not redeem the Points in its Program Account for Moments experiences or Miles or other benefits identified by Marriott from time to time. The Account Guardian is responsible for reviewing the terms and conditions for any available Loyalty Program benefits to determine if the Eligible Company may receive those benefits.
- After Marriott has issued the Points, the Eligible Company is responsible for ensuring that the Points are issued in accordance with Eligible Company’s policies and practices. Marriott will not be liable for any disputes arising between Eligible Company and its employees over the distribution or use of the Points.
6. Transfer of points to an eligible employee’s member account
An Eligible Company may transfer Points from its Program Account into an Eligible Employee’s Membership Account for use by the Eligible Employee in connection with the Loyalty Program (subject to the Loyalty Program Rules). If an Eligible Company transfers Points to an Eligible Employee’s Membership Account, the Eligible Company acknowledges and agrees that:
- Marriott cannot mandate, and will not be able to track, how (or if) such Points are used by the Eligible Employee.
- Marriott will not provide the Eligible Company with any information about how (or if) such Points are used by the Eligible Employee.
- After Marriott has issued the Points, the Eligible Company is responsible for ensuring that the Points are issued in accordance with Eligible Company’s policies and practices, and Marriott will not be liable for any disputes arising between Eligible Company and its employees over the distribution of the Points.
- After Marriott has issued the Points, they cannot be returned to the Program Account.
- Points may be transferred into an Eligible Company’s Program Account in accordance with the Loyalty Program Rules.
In order to receive Points from a Program Account, the Eligible Employee’s account must be in good standing and have been open for at least thirty (30) days with qualifying activity, or ninety (90) days without qualifying activity, as further detailed in the Loyalty Program Rules.
Any Points transferred to an Eligible Employee’s Membership Account will not count towards the Redemption Requirement for the Eligible Company.
7. Supplemental rewards
- An Eligible Company may, from time to time, earn additional Points (“Supplemental Rewards”), by participating in a promotion or a special offer in accordance with its terms and conditions (i.e., achieving milestones within a limited period, registering for the promotion).
- For any Supplemental Rewards in addition to any Points that an Eligible Company would otherwise earn pursuant to these Terms and Conditions, the multiplier applies only to the standard base Points that an Eligible Company would be eligible to earn pursuant to these Terms and Conditions.
- Marriott may correct Supplemental Rewards shown as credited to an Eligible Company’s Program Account at any time.
- Supplemental Rewards may not be exchanged or redeemed for cash, prizes or credit and are typically non-transferable.
8. Other principles
- By accepting any Program Awards, the Eligible Company acknowledges that it is responsible for determining whether it is eligible to receive Program Awards under applicable laws, gift policies and incentive policies. An Eligible Company must immediately notify Marriott if: (i) it is not eligible to receive Program Awards for any reason, including without limitation pursuant to any applicable laws, gift policies or incentive policies, or (ii) its Program Account has been credited with any Program Awards that the Eligible Company has not earned or is otherwise ineligible to receive.
- Marriott reserves the right, at any time and in its sole discretion, to adjust the Program Awards credited to an Eligible Company’s Program Account. This includes, without limitation, situations where the Eligible Company was not eligible to receive a specific benefit under these Terms and Conditions. Such adjustments may also apply to any Points issued to Eligible Employees.
- Program Awards may not be sold, bartered or transferred, except by Marriott or its authorized agents. Any attempted sale, barter, or unauthorized transfer will be deemed void. Marriott and its authorized agents may refuse to honor or recognize any Program Awards that Marriott believes may have been transferred, sold or bartered in violation of these Terms and Conditions. For the avoidance of doubt, this section doesn’t prohibit an Account Guardian from transferring Points to an Eligible Employee in accordance with these Terms and Conditions.
- An Account Guardian may request credits for Points earned in connection with a Qualifying Event that are not reflected in an Eligible Company’s Program Account by contacting the hotel where the Qualifying Event was held. To be eligible for credit, such a request must be received within one (1) year of the applicable Qualifying Event transaction.
- Program Awards may be subject to income or other applicable taxes. The Eligible Company is responsible for any such tax obligations, including payment and disclosure to relevant third parties. Marriott will not be liable for any tax liability, duty or other charges in connection with the issuance of any Program Awards.
- Marriott makes no warranties or representations, either expressed or implied with respect to type, quality or fitness of goods or services provided through the Program or by Participating Properties.
- If a Participating Property exits the Loyalty Program for any reason after an Eligible Company makes an Award Redemption Stay reservation, but before the applicable Eligible Employee’s stay, Marriott will endeavor to have such former Participating Property honor the reservation or assist in arranging equivalent accommodations nearby; however, Marriott cannot guarantee that any Award Redemption Stay or any other Program Awards that an Eligible Company or Eligible Employee is granted under the Program will be honored at such former Participating Property. Additionally, any special offers will be voided, and Loyalty Program benefits will not be provided to an Eligible Company if a Participating Property leaves the Marriott hotel system or discontinues its participation in the Loyalty Program before such offer is redeemed or such Loyalty Program benefit is provided, or with respect to any portion of a stay after a property leaves the Marriott hotel system or terminates participation in the Program.
- The Eligible Company agrees to indemnify, defend, and hold harmless Marriott, its subsidiaries, and its affiliates from any liability, costs, damages, and expenses (including reasonable attorneys’ fees) arising out of or relating to any claims, including, without limitation, any third-party claims, arising from a failure to disclose the receipt of any Program Awards, including, without limitation, any Points.
- An Eligible Company may contact Marriott via email for assistance with reservations, customer service, and Program Award or Award Redemption Stay requests. Inquiries about missing Points should be directed to the applicable property where the Qualifying Event or stay occurred.
- Marriott reserves the right to remove any Eligible Company from the Program at any time, with immediate effect and without written notice, for any reason and in Marriott's sole discretion, including, without limitation, the failure to meet the eligibility qualifications established and maintained by Marriott in its sole discretion.
- Marriott is not responsible for: (a) any loss or misdirection of, or delay in receiving, any Eligible Company application, correspondence, redemption requests, or Program Awards; (b) theft or unauthorized redemption or use of any Program Awards; (c) any acts or omissions of third parties, including but not limited to Participating Properties; or (d) any errors published in relation to the Program, including but not limited to any typographical errors, errors of description, errors regarding Participating Properties, and errors in the crediting or debiting of Program Awards from Eligible Company Program Accounts. Marriott reserves the right to correct any such errors at any time, without prior notice.
- All interpretations of these Terms and Conditions and the rules of the Program will be at Marriott’s sole discretion, and Marriott’s decisions will be final. In the event of any discrepancy between the English version and any translated version of these Terms and Conditions, the English language version will prevail.
- Marriott’s waiver of any breach of these Terms and Conditions by any Eligible Company shall not constitute a waiver of any other prior or subsequent breach of these Terms and Conditions. Marriott’s failure to enforce strict compliance with these Terms and Conditions by any Eligible Company shall not be deemed a waiver of any rights or remedies that Marriott may have against that or any other Eligible Company. Marriott may, at its sole discretion, waive compliance with these Terms and Conditions and may, from time to time, run promotions that provide enhanced benefits to select Eligible Companies.
- In no event will marriott international, inc., its subsidiaries and affiliates, its franchisees or licensees, any participating property, and each of their respective directors, officers, employees, and agents be liable for any direct, indirect, special, exemplary, punitive, incidental or consequential damages of any kind, whether based in contract, tort or otherwise, which arise out of or are in any way connected with this program, the loyalty program, these terms and conditions, or the company’s operation of the loyalty program or this program.
- Any disputes arising out of or related to the Program or these Terms and Conditions will be handled on an individual basis and not as part of any class action. These Terms and Conditions will be governed by, construed and enforced in accordance with the laws of the State of Maryland, United States, without regard to its conflicts of law rules. The exclusive jurisdiction for any claim or action arising out of or relating to these Terms and Conditions or the Program may be filed only in the state or federal courts located in the State of Maryland, United States.
- Participation in the Program, including the earning and redeeming of Program Awards, is subject to all applicable local laws and regulations. Participation in the Program and Program Awards are offered in good faith; however, they may not be available if prohibited or restricted by applicable law or regulation in the Unites States or the Eligible Company’s jurisdiction. If any provision of these Terms and Conditions is held to be unlawful or unenforceable in a particular jurisdiction, that part will be deemed deleted from these Terms and Conditions in such jurisdiction and the remaining provisions will remain in force and effect.
- Marriott and Participating Properties are the sole and exclusive owners or licensees of the trademarks, service marks, trade names, logos, and copyrighted or copyrightable materials of Marriott International, Inc., its affiliates, and the Participating Properties. Eligible Companies and Eligible Employees shall never, directly or indirectly, interfere with, challenge, file applications for, or claim ownership of these trademarks anywhere in the world.
- These Terms and Conditions, together with those incorporated herein or referred to herein, constitute the entire agreement between Marriott and the Eligible Company relating to the subject matter hereof, and supersede any prior understandings or agreements (whether oral or written) regarding the subject matter, and may not be amended or modified except in writing or by making such amendments or modifications available on the Program website.
